Terms of Sale.

How a used vehicle sale works at NOVO Budget — drive-away pricing, deposits, trade-ins, finance, the Queensland statutory warranty under the Motor Dealers and Chattel Auctioneers Act 2014, and your rights under the Australian Consumer Law.

    Who these terms apply to

    These Terms of Sale govern the sale of a used motor vehicle by NOVO Budget ("we", "us", "our") to you, the buyer, from our yard at 1366 Kingsford Smith Dr, Pinkenba QLD 4008.

    By placing a deposit on a vehicle, signing a contract of sale, or taking delivery of a vehicle from us, you agree to be bound by these terms. They sit alongside — and do not replace — your rights under the Australian Consumer Law (the ACL, Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Motor Dealers and Chattel Auctioneers Act 2014 (Qld).

    About our vehicles

    Every used vehicle we list is mechanically inspected and reconditioned where needed before it is offered for sale. We're happy to share the inspection summary for any car you're seriously considering.

    We make every effort to ensure the description, photographs, kilometres, year, condition and feature list of each vehicle are accurate. Vehicles are sold "as inspected" — please make sure you have inspected the vehicle and are satisfied with its condition before you sign.

    Drive-away pricing

    The advertised price on each listing is the drive-away price for a private buyer in Queensland and includes:

    • Queensland stamp duty on the vehicle;
    • Twelve months of registration (or the current registration balance, transferred);
    • Compulsory Third Party (CTP) insurance for the transferred registration period;
    • Number plate and registration transfer fees;
    • Dealer delivery and processing charges.

    Optional add-ons — for example, extended warranty, paint protection, tinting, finance establishment fees or motor insurance — are not included in the drive-away price and will be quoted separately and in writing before you commit.

    Deposits and holding

    A deposit secures a specific vehicle for you for an agreed period (usually up to 7 days) while you arrange finance, inspection or a test drive. The vehicle will not be sold to another buyer during that period.

    Deposits are refundable if your finance is declined, if the vehicle has a previously undisclosed defect, or if we cannot deliver the vehicle to the agreed standard. Deposits are non-refundable if you simply change your mind. We will always tell you whether a deposit is refundable before you pay it.

    Payment

    The balance of the purchase price is due at or before collection. We accept the following payment methods:

    • Bank transfer (EFT) — please allow time for the funds to clear before pickup;
    • Bank cheque made payable to NOVO Budget;
    • Finance settlement direct from an accredited lender;
    • Card payment (surcharges may apply and will be disclosed before you pay).

    Title in the vehicle passes to you once the full purchase price has been received in cleared funds.

  6. 06

    Trade-ins

    We accept trade-ins on most purchases. The trade-in offer we give you is based on the make, model, year, kilometres, condition, service history and current Queensland market demand for your vehicle.

    The written trade-in offer is valid for 7 days from the date we issue it, provided the vehicle arrives in the condition you described and with no material change in kilometres. If the condition or kilometres differ materially, we may need to re-quote.

    If your trade-in has finance owing on it, we will pay out the outstanding balance directly to your lender from the sale proceeds. You'll need to provide a current payout letter from your lender. Any equity remaining after the payout goes towards your new vehicle (or is paid to you).

    Finance

    Where you ask us to refer your finance enquiry to one of our accredited finance brokers or lenders, we do so with your consent. The broker or lender will make the credit decision; we are not the credit provider.

    We may receive a commission or referral fee from the broker or lender on a successful settlement. This is disclosed in writing at the time you apply. You are free to arrange your own finance through your own bank or broker instead.

    Finance approval is subject to the lender's normal credit criteria and to satisfying any conditions in the loan contract.

    Queensland statutory warranty

    Eligible used vehicles sold by a licensed Queensland motor dealer come with a statutory warranty as required by the Motor Dealers and Chattel Auctioneers Act 2014 (Qld). The length of the warranty depends on the age of the vehicle and its kilometres at the date of sale. We'll confirm the exact warranty period for your vehicle, in writing, on your contract of sale.

    The statutory warranty covers most defects in the vehicle that emerge during the warranty period and that would not reasonably have been apparent at the time of sale. It does not cover ordinary wear and tear, consumables, defects caused by misuse or accident, or items specifically excluded by the Act.

    If a problem covered by the warranty arises during the warranty period, contact us first. We will arrange the inspection and any required repair through our authorised repair network.

  9. 09

    Your rights under the Australian Consumer Law

    Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded by contract. Our vehicles come with consumer guarantees that they will be:

    • Of acceptable quality, taking into account the age, price and description;
    • Reasonably fit for any purpose you told us about before you bought;
    • Matching the description, sample or demonstration model we gave you;
    • Free from any undisclosed security interest.

    Where one of these consumer guarantees is not met, you are entitled to a repair, replacement or refund — and to compensation for any other reasonably foreseeable loss or damage — in accordance with the ACL.

    Delivery, risk and registration

    You can collect your vehicle from our Pinkenba yard, or we can arrange delivery across Greater Brisbane and most of South-East Queensland for an additional fee that we'll quote upfront.

    Risk in the vehicle passes to you on collection or, where we deliver, on the moment of delivery. We strongly recommend you have comprehensive motor insurance arranged before you drive the vehicle away.

    We handle the transfer of Queensland registration to your name as part of the sale. Where you are registering the vehicle in another state, we'll provide all the documentation you need to complete the transfer with the relevant state authority.

  11. 11

    Cooling-off

    Queensland law does not provide an automatic cooling-off period for an in-person purchase of a used motor vehicle from a licensed dealer at the dealer's premises. Please make sure you are satisfied with the vehicle, have inspected it (and ideally test-driven it), and understand the terms before you sign.

    Where the law provides specific cooling-off rights — for example, certain finance contracts — those rights apply and will be set out in the relevant contract documentation.

    Returns, complaints and disputes

    If something is wrong with your vehicle, or you have a concern about your purchase, contact us first so we have a chance to put it right. Email info@novobudget.com.au or call +61 404 745 232.

    If we can't resolve your concern, you can refer the matter to the Queensland Office of Fair Trading or, where relevant, the Queensland Civil and Administrative Tribunal (QCAT) at qcat.qld.gov.au. Nothing in this section prevents you from exercising any other rights you have under the ACL or any other applicable law.

  13. 13

    Limitation of liability

    To the maximum extent permitted by law, and subject to the consumer guarantees in the ACL and the QLD statutory warranty described above, our liability for any loss or damage arising out of the sale of a vehicle is limited to the price paid for the vehicle. We are not liable for indirect or consequential loss, including loss of profits, loss of use, or loss arising from delay in delivery.

    Governing law

    These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that hear appeals from those courts.

  15. 15

    Changes to these terms

    We may update these Terms from time to time as our business or the law changes. The version that applies to your purchase is the one in force at the date of your contract of sale.
